Terms of Service

Last updated: July 8, 2026

These Terms of Service (“Terms”) govern your use of the MedServ website located at mymedserv.com and any website-based communications, forms, content, or information provided by MedServ (“MedServ,” “we,” “our,” or “us”).

By using the website, submitting a form, or contacting MedServ through the website, you agree to these Terms. If you do not agree, do not use the website.

  1. Website Purpose

The MedServ website provides information about MedServ’s medical facility maintenance, repairs, service calls, preventive maintenance, vendor coordination, documentation, renovation, buildout, and related facility support services.

The website is intended for general business and informational purposes only. Website content does not create a professional relationship, service agreement, customer relationship, or binding obligation unless and until MedServ and the client enter into a separate written agreement.

  1. No Medical, Legal, Engineering, or Compliance Advice

The website does not provide medical advice, legal advice, engineering advice, architectural advice, code compliance advice, licensing advice, or regulatory advice.

Any information on the website is general in nature and should not be relied upon as a substitute for advice from qualified professionals. Medical practices and facility operators are responsible for their own compliance obligations, licensing requirements, clinical operations, building requirements, and professional advice.

  1. No Emergency or Critical-Service Use

The website and contact forms are not emergency reporting systems and should not be used for urgent, life-safety, patient-safety, utility-failure, security, fire, flood, clinical, or other emergency situations.

For emergencies, contact appropriate emergency services, building management, utility providers, licensed professionals, or other responsible parties directly.

  1. Service Inquiries and Walkthrough Requests

Submitting a contact form, scheduling request, or service inquiry does not guarantee availability, response time, pricing, acceptance of work, or performance of services.

Any services, project work, maintenance programs, renovations, buildouts, or vendor coordination are subject to separate review and may require a written proposal, scope of work, estimate, service agreement, purchase order, deposit, site access, permits, third-party availability, and other conditions.

MedServ may decline, modify, or refer requests at its discretion.

  1. Separate Agreements Control

If you enter into a separate written agreement with MedServ, that agreement will control the specific services, fees, payment terms, responsibilities, limitations, warranties, deliverables, and other terms related to that work.

If these website Terms conflict with a signed written agreement between you and MedServ, the signed written agreement controls for the covered services.

  1. Platform and Client Portal Access

MedServ may provide clients with access to a platform, portal, work order system, dashboard, or other digital tools. Access to those tools may be subject to separate agreements, account terms, user permissions, or client-specific rules.

Users are responsible for maintaining the confidentiality of login credentials and for activity under their accounts. You must notify MedServ promptly if you believe account access has been compromised.

  1. User Submissions

When you submit information through the website, you agree that:

  • The information you provide is accurate to the best of your knowledge.
  • You have authority to submit the information on behalf of yourself, your practice, company, or organization.
  • You will not submit patient records, protected health information, confidential medical information, insurance information, diagnosis information, treatment information, access credentials, or other sensitive patient data through the website form.
  • You will not submit unlawful, misleading, harmful, infringing, or malicious content.

You grant MedServ permission to use information you submit to respond to your inquiry, evaluate service needs, communicate with you, coordinate requested services, and operate our business.

  1. Communications

By contacting MedServ through the website, you authorize MedServ to respond using the contact information you provide, including by email or phone.

MedServ may send service-related, administrative, scheduling, proposal, or follow-up communications. Marketing communications, if any, will be handled in accordance with applicable law and available opt-out mechanisms.

  1. Acceptable Use

You agree not to:

  • Use the website for unlawful purposes
  • Attempt to gain unauthorized access to the website, systems, forms, accounts, or data
  • Interfere with website security or operation
  • Upload or transmit malware, scripts, spam, or harmful code
  • Scrape, copy, or harvest website content or data in an abusive manner
  • Misrepresent your identity, affiliation, or authority
  • Submit false, misleading, confidential, protected, or unauthorized information
  • Use the website in a way that could damage MedServ, its clients, vendors, users, or systems
  1. Intellectual Property

The website, design, text, graphics, logos, images, service descriptions, layout, and other content are owned by MedServ or used with permission and are protected by intellectual property laws.

You may view and use the website for your internal business evaluation of MedServ services. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit website content without written permission from MedServ.

  1. Third-Party Services and Links

The website may use or link to third-party tools, plugins, hosting providers, analytics providers, form tools, email systems, maps, websites, or other services.

MedServ is not responsible for third-party websites, services, availability, security, content, policies, or practices. Your use of third-party services may be governed by their own terms and privacy policies.

  1. Website Availability and Changes

MedServ may update, modify, suspend, or discontinue any part of the website at any time without notice.

We do not guarantee that the website will always be available, uninterrupted, error-free, secure, or current.

  1. Disclaimers

The website and website content are provided “as is” and “as available.”

To the fullest extent permitted by law, MedServ disclaims all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, availability, security, and uninterrupted operation.

MedServ does not warrant that website content is complete, current, or suitable for your specific facility, practice, location, project, regulatory environment, or operational needs.

  1. Limitation of Liability

To the fullest extent permitted by law, MedServ will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or similar damages arising from or related to your use of the website, inability to use the website, reliance on website content, form submissions, electronic communications, third-party services, or these Terms.

For website-related claims not governed by a separate written agreement, MedServ’s total liability will not exceed $100.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

  1. Indemnification

You agree to defend, indemnify, and hold harmless MedServ and its owners, officers, employees, contractors, vendors, and representatives from and against claims, damages, losses, liabilities, costs, and expenses arising out of or related to:

  • Your unauthorized submission of confidential, regulated, protected, or patient information
  1. Privacy

Your use of the website is also governed by our Privacy Policy, available at:

  1. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, unless a separate written agreement between you and MedServ states otherwise.

For website-related disputes not governed by a separate written agreement, you agree to the exclusive jurisdiction and venue of state or federal courts located in Florida.

  1. Changes to These Terms

MedServ may update these Terms from time to time. When we update them, we will revise the “Last updated” date above.

Your continued use of the website after updated Terms are posted means you accept the updated Terms.
